I (the "customer") understand and agree that all
purchases made by me are subject to the following terms and conditions of sale.
1. No replacement or
refund will be due to the Customer due to an act of God or any weather problems,
reduction of power, any other force majeure, or in the event that an address
submitted to Floral Fund LLC (the "Shipper") by the Customer is in
any way incorrect or inaccurate. The Shipper will be the only one to make the
final decision regarding incorrect or inaccurate addresses. No orders accepted
for delivery outside the continental United States.
2. No
deliveries on Sunday or Monday.
3. Proper
address must be given and a complete zip code, apartment number, suite, and
address must be provided. Only items marked under the heading “Gifts for the
Troops” can be sent to APO or a military or foreign addresses. Under no
circumstances will orders be delivered to PO boxes.
4. A $10.00
charge will be added to your credit card for any error on the delivery address
due to your error, and may delay delivery date.
5. The
carrier will determine at their sole discretion if it is safe to leave the
flowers if no one is available to accept delivery. If no one is available for
acceptance or a delivery, the carrier may elect to deliver the next business
day. The Customer will be solely responsible for any damage to the flowers or
for lack of quality of the contents after the date of the initial attempted
delivery.
6. The
Shipper will not deliver to any schools of any kind.
7. All orders
must be placed by 2:00 P.M eastern time for next business day delivery.
8. Delivery
of flowers of Saturday will involve an additional charge, to be determined by
the Shipper.
9. Except as
provided for above, deliveries may arrive anytime from 9:00 A.M- 6:00 P.M local
time in the place of delivery, the business day after an order is placed.
10. You
acknowledge and understand that most office and multi-family buildings may only
accept orders at a front desk, and the recipient is responsible for collecting
the flowers from such central location. The Shipper is not responsible for any
delay in the flowers ultimately reaching the recipient in such a situation.
11. The
Customer and/or recipient must take care of flowers according to the instructions
placed with the flowers. Shipper has no responsibility for damage to flowers
caused by the Customer or recipient not following proper instructions.
12. Customer
recognizes that flowers have a limited life, and are not guaranteed to last
past the day of receipt. In the event that Customer or recipient receives
flowers in damaged or wilted condition, Customer or recipient must notify the
Shipper and ship the flowers back to the Shipper in the original shipping
container no later than the day after delivery, for replacement.
13. Should
another color be sent due to the grower’s inability to ship the color requested
by the Customer, there will be no refund or replacement.
14. No refund of any kind will be issued to the Customer for any
reason. Replacements will be allowed, subject to the above terms and
conditions.
